By participating in the beta testing program for the glowswitch device (the "Device"), you ("Tester," "you," or "your") agree to the following terms. If you do not agree, please do not participate.

1. Purpose of Beta Testing

This beta testing program ("Program") is designed to gather real-world feedback on the functionality, performance, and user experience of a pre-release version of the glowswitch device. Your input will help us improve the product before general release.

2. Age Requirement

You must be at least 18 years old to participate, as you are entering into a legal agreement.

3. Device and Software License

  • We provide you with a license to use the Device and any associated software or apps ("Software") solely for testing purposes.
  • All intellectual property rights in the Device and Software remain owned by us or our licensors.
  • You may not copy, redistribute, reverse engineer, or modify the Device or Software, except as required by law.

4. Testing Responsibilities

As a Tester, you agree to:

  • Use the Device in a safe and responsible manner, following all provided instructions.
  • Test the Device under typical home conditions.
  • Provide honest and constructive feedback about your experience, including bugs, usability issues, and suggestions.
  • Submit feedback through the channels we designate (e.g., email, online form, survey).

We appreciate your time and effort in helping us improve the product.

5. Feedback

  • Any feedback, comments, or suggestions you provide ("Feedback") will be used by us to improve the Device and related products.
  • By submitting Feedback, you grant us a perpetual, worldwide, royalty-free license to use, modify, and incorporate your input into our products and services.
  • You represent that your Feedback does not infringe any third-party rights.

6. Data Collection

  • We do not collect any usage data, diagnostic information, or personal data from the Device during the beta test. The Device does not communicate with us or any third party over the Internet.
  • The only information we receive is what you voluntarily provide through feedback channels.
  • If this changes in the future, we will notify you and obtain your consent before any new data collection begins.

7. Warranty Disclaimer

  • The Device and Software are provided "as is" and may contain bugs or performance issues.
  • We make no warranties of any kind, express or implied, including but not limited to merchantability or fitness for a particular purpose.
  • The Device is not a consumer product at this stage and is intended solely for evaluation.

8. Limitation of Liability

To the fullest extent permitted by law:

  • We are not liable for any indirect, incidental, or consequential damages related to your use of the Device.
  • Our total liability to you for any claim arising from this Program is limited to the replacement or repair of the Device, at our option.

You assume all risks associated with using a pre-release product.

9. Term and Termination

  • The beta test begins on August 5, 2025 and will end at our discretion
  • Either you or we may end your participation at any time.
  • If we terminate your participation or the Program ends, you may keep the Device unless we notify you otherwise.

10. No Return Required

Unless we specifically request it, you are not required to return the Device after the beta test. It is yours to keep as a thank-you for your participation.

11. Governing Law

These terms are governed by the laws of the United Kingdom.

12. Changes to These Terms

We may update these Terms from time to time. If we make significant changes, we will notify you via email or in-app message. Continued participation after changes constitutes acceptance.
